Directions on Sanitation Management of Deep Sea Fishing Vessels for Qualification by EU Related Regulations

1. Council of Agriculture (COA) (hereinafter referred to as "the authority") of Executive Yuan establishes this directions to improve the hygiene management of deep sea fishing vessels and ensure the hygiene of fish catch and transportation operations comply with European Union (hereinafter referred to as “EU”) provisions.
2.Fisheries Agency enforces the requirements pertaining in this direction. Fisheries Agency may authorize the domestic or foreign control bodies (hereinafter referred to as “control bodies”)to conduct the hygiene inspection of deep sea fishing vessels and the hygiene training of captains if necessary.
3.When fishery operators delivering fish catch to EU regions, the deep sea fishing vessel shall be first listed in EU (hereinafter referred to as “EU listed deep sea fishing vessel”) and the hygiene of fish catch shall comply with EU provisions.
4.Vessel applies to be accorded as an EU listed deep sea fishing vessel shall be inspected by Fisheries Agency and acquires Fisheries Agency’s hygiene approval in advance. The inspection includes document review and on-site inspection.
5.Fishery operators applying for EU listed deep sea fishing vessel approval shall submit the following documents through its affiliated fishery organization to Fisheries Agency or the authorized control body for document review.
(1) Application form (Attachment 1).
1.General information.
2.Copy of fishing license
3.Copy of diagram of fishing vessel layout
4.Crew organizational charts and the responsibility of hygiene management plan.
5.Certificates certifying captains have completed and passed the courses of the EU hygiene training
6.Equipments for handling fish catch and the hygiene control measures of the equipments.
7.Self-inspection records for EU listed deep sea fishing vessel.
8.Attachments (Please number pages accordingly).
(1)Photos of equipments for handling fish catch
(2)Temperature record of the last voyage. (vessel with newly installed thermometer shall attach testing report of freezer).
(3)Hygiene control plans.
(4)Others
Upon receiving application from fishery operators, Fisheries Agency or the authorized control bodies shall complete the document review within 15 days and inform the fishery operators to arrange on-site inspection.
If document submitted is inaccurate or inadequate, Fisheries Agency shall notify the fishery operators to take corrective action within 15 days after the date they are been notified . Overdue application shall be rejected.
Fisheries Agency shall promulgate the fishery organization referred in point 1 of this article.
6.Fisheries Agency or the authorized control bodies shall arrange the on-site inspection within 15 days after completion of document review.
Standards for on-site inspection are listed in Attachment 2, interview with the captain should also be included.
7.Upon completion of on-site inspection, Fisheries Agency shall inform fishery operators the results of inspection in writing within 7 days. Should there be any disagreement with the inspection results, Fisheries Agency could constitute a committee, which is formed by competent authority, scholars, and specialists concerned and the conclusion of the committee shall be forwarded to the fishery operators in writing within 7 days.
A list of the approved vessels shall be compiled by Fisheries Agency and update to EU via Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs.
Fishery operators may take corrective action and re-apply for inspection within 3 months from the date receiving non-approval notification. Fisheries Agency or the authorized control bodies shall schedule on-site re-inspection within 15 days upon receiving the application from fishery operators.
Fishery operators shall re-submit application in accordance with Article 5 if they fail the on-site re-inspection again.
8.The status is valid for 5 years once approved. Fishery operators shall apply for re-inspection 6 months prior to the expiration date in accordance with Article 5.
The approved EU deep sea fishing vessels shall schedule regular surveillance once every 3 years. Additional surveillances may be arranged if deemed necessary. The regular surveillance verifies whether the vessels comply with the sanitary standards that were approved (Attachment 3). Should vessels found failing on the surveillance, fishery operators shall take corrective action and apply for re-inspection within 3 months from the date receiving noncompliance notification.
Fisheries Agency or the authorized control bodies shall schedule on-site re-inspection within 15 days upon receiving the application from fishery operators.
Fishery operators shall re-submit application in accordance with Article 5 if fishery operators again fail the on-site re-inspection of regular surveillance process.
9.Captains of the EU listed deep sea fishing vessel shall receive a minimum of 12-hour hygiene training from Fisheries Agency. Hygiene training shall include relevant EU regulations, fishing vessel hygiene audit standards, hygiene management of fish catch, and the points for attention on the captain declaration.
In case of vessels fishing in remote places, captains may receive distance learning training within 3 years after the promulgation of this direction.
10.Fisheries Agency shall issue certificate, valid for 5 years, to captains who completed the training and passed the test. Fisheries Agency shall issue training certificates, valid for 3 years, to captains who complete the distance learning training and pass the test. Fisheries Agency shall file a list of the signatures of the qualified captains. Captains shall attend re-training and receive training certificate, which is valid for another 5 years, after the current certificate expires.
Fisheries Agency may conduct distance learning re-training for qualified captains for amended sanitary requirements.
Captains shall apply for re-training from Fisheries Agency 6 months prior to the expiration of the certificate. The re-training is 6 hours minimal and the certificates shall be renewed for qualified captains.
11.Fisheries Agency may authorize trained and qualified captains to use the Checklist of Captain’s Declaration (Attachment 4) to verify whether the vessel and the fish catch comply with the EU sanitary standards. Captains could issue captain declaration (Attachment 5) if fish catch comply with the EU sanitary standards. Captain declaration shall consist of 3 copies.
The list of the authorized qualified captains shall be promulgated by Fisheries Agency.
12.Captains of EU listed deep sea fishing vessel shall not issue Captain’s declaration if confronts with the followings: .
(1) Captains do not pass the training pertaining in Article 10.
(2) Non-compliance of EU temperature requirement for fish catch during operation
(3) Fishing vessel is contaminated during operation.
(4) Fish catch is not harvested by the employed fishing vessel.
For Captains committed serious violation by signing captain declaration not in accordance with this direction may result in notification to EU by Fisheries Agency via Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs
13.In the event of an EU listed deep sea fishing vessel found to commit any one of the following circumstances, Fisheries Agency shall notify EU to withdraw it from the list via Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs.
(1)Fishery operators apply for hygiene inspection using fraud documents.
(2)Fishery operators who fail the re-inspection and the regular surveillance and do not re-apply in accordance with Article 8. Fishery operators that are in the re-examine process are excluded
(3)Fish catch, delivered to EU regions, fails to meet with EU provisions and do not take corrective actions or those result in serious violations.
(4)Loss of deep sea fishing vessel.
(5)Fishery operators do not submit relevant hygiene information of fish catch to Fisheries Agency in accordance with this direction.
14. The deep sea fishing vessel removed from the list may re-apply for approval 1 year after the withdrawn date Fisheries Agency notified EU via Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs.
Captains who have been notified to EU via Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs as disqualified to issue captain declaration shall not apply for re-training within 3 years after notification date.
15.Fishery operators shall submit written information regarding any changes of EU listed vessels, fishery operators and name of vessels to Fisheries Agency. Fisheries Agency after collecting all information shall notify EU regarding the changes via Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs.
16.Fishery operators of EU listed deep sea vessels shall submit or fax each of the sales information within 7 days after delivering fish catch to EU regions.
Captains shall submit temperature records of vessels for each voyage to the fishery operators and Fisheries Agency for filing, serving the purpose of basis for future hygiene inspection and regular surveillance.
17.When fish catch of EU listed deep sea fishing vessels are marketed to non-EU regions, the vessel hygiene inspection, captain training and issuance of captain declaration shall comply with this direction.
18.Vessels already been listed as an EU listed deep sea fishing vessels prior to the promulgation of this direction shall comply with this direction in acquiring necessary inspection within 2 years after promulgation. Vessels fail to comply with this aforementioned will be notified by Fisheries Agency via Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs to EU in requesting be removed from the list.
19.Fishery operators shall fill in 4 copies of “Fish Catch Marketing Flow Recordd“ (attachment 6) when the catch markets to the EU coded processing plants. The Record shall be delivered to Bureau of Standards, Metrology and Inspection of Ministry of Economic Affairs via the transporters and processing plants.
The Fish Catch Marketing Flow Record is effective for one year after fishery operators sold the fish catch..
