Notice on the Application for Loans for the Building of Ultra Low Temperature Fish Transport Vesselst

Announced by the Council of Agriculture, Executive Yuan on 23 July 1996 under letter of notice No. 85 Nung-Yu-Tzu 5040639A.

1. In order to make use of the low interest loan under Sino-American Fund, and for the purposes of encouraging the fishing industry to build ultra low temperature fish transport vessels over 2,000 GRT, to meet with the marketing of ultra low temperature fish and to improve the quality of fish, while preventing the domination of the transport of ultra low temperature fish by foreign cargo vessels, the Council of Agriculture (hereinafter referred to as “COA”) has hereby made this Notice.
2. Subject of loans: Building of fishing vessels of more than 2,000 GRT which has been permitted by the fisheries administrative authority, with the structure of the vessels and equipments consistent with the following:

(1) The structure of the vessel and the equipments on board must meet the requirements of the applicable shipping act and regulations in force, passed the inspection of the shipping authority. In order to improve its standard to that of the international standard, it has to pass the classification inspection by China Corporation of Shipping Registration and obtained the following certificates complying with international conventions:

1. International load line certificate.
2. Certificate of safety structure of cargo ships.
3. Certificate of safety equipments of cargo ships.v
4. Certificate of safety radio for cargo ships.
5. Certificate indicating crew living quarters meeting the requirement of International Labor Organization 92.
6. International Tonnage Certificate.
7. Certificate on the prevention of oil pollution.

(2) The equipments, materials and design of its fish holds must meet with the requirement of general frozen fish transport ships. The freezing capacity of its refrigerating machine is capable of keeping the temperature of the fish holds at -60 degrees C. (+/-5 degrees) when the hatches closed, and so tested by China Corporation for Shipping Registration.

3. Amount of loan: Quota of one ultra low temperature fish transport vessel of 2,000 GRT or over, with the maximum loan amount of NT dollars 70 million. (In case there are more than one applicants, it will be decided by drawing of lots.)
4. Interest rate: Based on 70% of the prime lending rate of Farmers Bank of China, but not less than the minimum lending rate of the Agriculture Development Funds.
5. Term of loan: 10 years
6. Condition of collateral as required by the credit providing bank.
7. Form of payment: First year only payment of interests. From the second year to the tenth year (9 years), by 18 equal installments of credit amount plus interests.
8. Forms of application and approval of loan:

(1) Deadline of application: from the date of notice until 31 October 1996.
(2) Preliminary examination: The applicant shall submit two copies of the following documents to the Council of Agriculture for application:

1. Form of basic information (format as in Annex) of the ultra low temperature fish transport vessel applied for building.
2. Copy of the letter of building permission from the fisheries administrating agent.
3. Copy of the shipbuilding contract signed with the shipbuilder.
4. Copy of the letter to China Corporation of Shipping Registration applying for classification of ship, and copy of their reply indicating acceptance of the application.

(3) Preliminary examination by COA will be completed before 30 November 1996, and the applicant will be duly notified of the result.
(4) The applicant shall, within two months of the receipt of notification of passing the preliminary examination, submit the original of the certificate of building commencement to COA for record. Failure to produce the certificate of building commencement, the building permit will be subject to cancellation.
(5) Reexamination: After completion of the installation of the relating equipments the applicant shall submit copies of the following documents to COA applying for reexamination:

1. COA’s letter of notification of the result of the preliminary examination.
2. Certificate of inspection of the vessel.
3. Inspection record of the vessel.v
4. Certificate of registration of the vessel.v
5. Certificate of classification of ship.v
6. The certificates in compliance with international conventions as required in paragraph 2(1) of this Notice and proof of passing the test as required in paragraph 2 (2) of this Notice.

(6) From the reexamination, if COA is satisfied that the structure and the equipments of the vessel has met the above requirements, it will reply in writing to the applicant to apply for the loan from the Farmers Bank of China with copy to the said bank.
